الشروط والأحكام – تطبيق بوشنا (BOSHNA)

تُعد هذه الشروط والأحكام اتفاقية قانونية ملزمة بين شركة بوشنا لخدمات الأعمال (ويشار إليها بـ "نحن" أو "التطبيق") وبين المستخدم (سواء كان بائعاً، مشترياً، أو مقدم خدمة). باستخدامك للتطبيق، فإنك تقر بموافقتك الكاملة على الالتزام بهذه الشروط.
1. تعريف الخدمة
تطبيق بوشنا هو منصة إلكترونية وسيطة (Marketplace) تتيح للمستخدمين عرض وبيع وشراء الحيوانات والسلع والخدمات المرتبطة بها. بوشنا لا يملك ولا يبيع ولا يضمن السلع المعروضة، ولا يعد طرفاً في عملية البيع أو التعاقد التي تتم مباشرة بين المستخدمين.
2. أهلية الاستخدام والتسجيل
يجب أن يكون عمر المستخدم 18 عاماً على الأقل، وأن يتمتع بالأهلية القانونية الكاملة.
يلتزم المستخدم بتقديم معلومات دقيقة (الاسم، الجوال، السجل التجاري إن وجد) وتحديثها فور تغيرها.
الحساب شخصي، والمستخدم مسؤول عن كافة الأنشطة التي تتم من خلال حسابه.
3. شروط الإعلان عن الحيوانات والسلع
وصف السلعة: يلتزم البائع بتقديم وصف دقيق وصادق وصور واقعية وحديثة للحيوان أو المنتج المعروض.
صحة وسلامة الحيوان: يقر البائع بمسؤوليته القانونية والشرعية عن خلو الحيوان من الأمراض المعدية أو العيوب الخفية غير المعلنة وفقاً للأنظمة البيطرية في المملكة.
مسؤولية الفحص: يقر المشتري بأن معاينة الحيوان أو السلعة وفحصها طبياً أو فنياً قبل إتمام عملية الشراء هي مسؤوليته الشخصية، ولا يتحمل التطبيق أي تبعات ناتجة عن عيوب تظهر بعد التسليم.
4. إخلاء المسؤولية
الوساطة فقط: بوشنا لا يضمن جودة أو سلامة أو مشروعية أي حيوان أو منتج معروض.
النزاعات: بوشنا غير مسؤول عن أي خلافات تنشأ بين البائع والمشتري بخصوص الأسعار، الحالة الصحية للحيوان، أو جودة المنتج.
الانقطاع التقني: نبذل جهدنا لاستقرار الخدمة، ولكننا لا نضمن عدم حدوث انقطاع تقني طارئ ولا نتحمل المسؤولية عن أي أضرار ناتجة عن ذلك.
5. الرسوم والعمولات
يحق للتطبيق فرض رسوم أو عمولات على العمليات الناجحة أو الخدمات الإعلانية (مثل تمييز الإعلانات).
يتم توضيح الرسوم للمستخدم قبل إتمام العملية، وهي غير قابلة للاسترداد بعد تقديم الخدمة.
6. الشحن والتوصيل
في حال استخدام خدمات التوصيل عبر أطراف ثالثة، تنتهي مسؤولية بوشنا بمجرد تسليم السلعة للناقل، وتخضع العملية لشروط وأحكام شركة الشحن المتعاقد معها.
7. المحتوى والسلوك العام
يُمنع نشر إعلانات لسلع تخالف أنظمة المملكة العربية السعودية أو الأخلاق العامة.
يُمنع استخدام الرسائل النصية أو الصوتية داخل التطبيق لأغراض الاحتيال أو الإساءة للأطراف الأخرى.
يحتفظ التطبيق بالحق في حذف أي محتوى أو حظر أي حساب يخالف هذه الشروط دون إشعار مسبق.
8. الملكية الفكرية
كافة حقوق الملكية الفكرية المتعلقة بالتطبيق (العلامة التجارية، التصاميم، الكود البرمجي) هي ملك لـ شركة بوشنا لخدمات الأعمال. لا يجوز اقتباس أو استخدام أي جزء منها دون إذن خطي مسبق.
9. إنهاء الخدمة
يحق لـ بوشنا تعليق أو إلغاء حساب أي مستخدم في حال خرق هذه الشروط، أو القيام بتقديم بلاغات كاذبة، أو محاولة الإضرار بنزاهة المنصة.
10. القانون والولاية القضائية
تخضع هذه الشروط وتُفسر وفقاً للأنظمة المعمول بها في المملكة العربية السعودية. ويتم الفصل في أي نزاع ينشأ عنها أمام المحاكم المختصة بمدينة الرياض.

These Terms and Conditions constitute a legally binding agreement between Boshna Business Services Co. (referred to as "we" or "the App") and the user (whether a seller, buyer, or service provider). By using the App, you acknowledge your full agreement to comply with these terms.
1. Definition of the Service
Boshna App is an intermediary electronic platform (Marketplace) that allows users to display, sell, and buy animals, goods, and related services. Boshna does not own, sell, or guarantee the goods offered, and is not a party to the sale or contracting process that takes place directly between users.
2. Eligibility and Registration
The user must be at least 18 years old and have full legal capacity.
The user undertakes to provide accurate information (name, mobile number, commercial registration if any) and to update it as soon as it changes.
The account is personal, and the user is responsible for all activities carried out through their account.
3. Terms for Advertising Animals and Goods
Item description: The seller undertakes to provide an accurate and honest description and realistic, recent images of the animal or product offered.
Animal health and safety: The seller acknowledges their legal and Sharia responsibility for the animal being free of contagious diseases or undisclosed hidden defects, in accordance with the veterinary regulations of the Kingdom.
Inspection responsibility: The buyer acknowledges that inspecting the animal or item and examining it medically or technically before completing the purchase is their personal responsibility, and the App bears no consequences arising from defects that appear after delivery.
4. Disclaimer
Intermediation only: Boshna does not guarantee the quality, safety, or legality of any animal or product offered.
Disputes: Boshna is not responsible for any disagreements arising between the seller and buyer regarding prices, the animal's health condition, or product quality.
Technical interruption: We make every effort to keep the service stable, but we do not guarantee that no emergency technical interruption will occur, and we bear no responsibility for any damages resulting from that.
5. Fees and Commissions
The App has the right to charge fees or commissions on successful transactions or advertising services (such as featuring listings).
Fees are clarified to the user before completing the transaction, and they are non-refundable after the service is provided.
6. Shipping and Delivery
In the event that delivery services are used through third parties, Boshna's responsibility ends once the item is handed over to the carrier, and the process is subject to the terms and conditions of the contracted shipping company.
7. Content and General Conduct
It is prohibited to post advertisements for goods that violate the regulations of the Kingdom of Saudi Arabia or public morals.
It is prohibited to use text or voice messages within the App for purposes of fraud or abuse of other parties.
The App reserves the right to delete any content or block any account that violates these terms without prior notice.
8. Intellectual Property
All intellectual property rights related to the App (trademark, designs, source code) are the property of Boshna Business Services Co. No part of it may be quoted or used without prior written permission.
9. Termination of Service
Boshna has the right to suspend or cancel any user's account in the event of a breach of these terms, the submission of false reports, or an attempt to harm the integrity of the platform.
10. Law and Jurisdiction
These terms are governed by and interpreted in accordance with the regulations in force in the Kingdom of Saudi Arabia. Any dispute arising from them shall be settled before the competent courts in the city of Riyadh.
